Welcome to Avocett
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of
an entity ("you") and Avocett LLC ("Company", "we", "us", or "our"), concerning your access to and use of the
Avocett analytics platform and related services as well as any other media form, media channel, mobile website or mobile
application related, linked, or otherwise connected thereto (collectively, the "Service"). The Service provides
comprehensive analytics and automation solutions for businesses (the "Platform Offerings"). In
order to help make the Service a secure environment for the use of Platform Offerings, all users are
required to accept and comply with these Terms of Use.
Supplemental terms and conditions or documents that may be posted on the Service from time to time are hereby
expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or
modifications to these Terms of Use at any time and for any reason.
The information provided on the Service is not intended for distribution to or use by any person or entity in any
jurisdiction or country where such distribution or use would be contrary to law or regulation or which would
subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to
access the Service from other locations do so on their own initiative and are solely responsible for compliance with local
laws, if and to the extent local laws are applicable.
How our platform works
This section will help you understand what you are accessing when you use our platform and how that usage
takes place on Avocett.
1. What you're accessing:

Service License: When you use our platform, you acquire
the right to access and use our analytics and automation services; you're not acquiring ownership of
the underlying technology. What you get includes a license directly from Avocett to use our platform services. Services are subject to specific
terms of use, and these terms constitute the 'license' that we grant on Avocett. This license also applies to you if you access
services that someone else in your organization has subscribed to (because anyone accessing services needs to be an authorized user).
Different service tiers are available for you to choose when you have selected our platform. You'll need to think about the way you
want to use the services so that you can pick the right tier to allow that use. It's your responsibility to choose the
correct service level.

Platform support: Avocett provides comprehensive support for all our platform services. This
includes technical support, training resources, and consultation services. All active subscriptions include a support period. You can upgrade support levels for
premium services. Your right to access Platform Support requires an active Avocett account.

User Services: In addition to the use of
the platform, when you subscribe to our services you also receive user services from
Avocett like 24/7 customer support, data security protection, service quality assurance and other related user services.
2. The total price for services on Avocett is made up of:

Service price: The service price is made
up of a subscription fee (for the service tier you choose), and if relevant additional usage fees (for premium features and usage beyond base limits).

Platform fee: This is the fee
for the platform services you get from Avocett.

Processing fee: In some
transactions on Avocett the total checkout price may include a processing fee for payment handling.

Taxes: Some transactions on Avocett
may be subject to tax that may be added to the price. See section 23 for
details about taxes on Avocett services.
Data Privacy and Security
At Avocett, we take data privacy and security seriously. We implement industry-standard security measures
to protect your data and ensure compliance with applicable data protection regulations. Your data remains
your property, and we act as a data processor in accordance with our Privacy Policy.
We do not sell, trade, or share your data with third parties except as necessary to provide our services
or as required by law. All data processing activities are conducted in accordance with our Privacy Policy
and applicable data protection laws.
Service Availability
We strive to maintain high availability of our services, but we cannot guarantee uninterrupted access.
Scheduled maintenance will be communicated in advance when possible. We are not liable for service
interruptions due to circumstances beyond our reasonable control.
Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these Terms. You may not
use our services to engage in any illegal activities, violate any third-party rights, or attempt to
gain unauthorized access to our systems or other users' data.
